1. Acceptance of Terms

Welcome to Spellweave. By accessing or using our Magic: The Gathering deck building application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or sending you an email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

Spellweave provides tools for Magic: The Gathering players to:

• Import and manage card collections
• Build and optimize decks using AI-powered algorithms
• Generate AI-powered deck explanations and strategy guides
• Create AI-generated strategy visualizations
• Export collections and decks in various formats
• Share decks via public links

The Service may include free and paid features. Certain features require a subscription or mana purchase.

3. Account Registration

To use most features of Spellweave, you must create an account. When registering, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 13 years old (or 16 in the European Economic Area) to create an account and use our Service.

4. Beta Access

Spellweave is currently in open beta. During the beta period:

• Features may be incomplete, contain bugs, or change without notice
• We may reset data or make changes that affect your saved content
• The Service is provided "as is" with no guarantees of availability or reliability

By using Spellweave during the beta, you understand and accept these conditions.

5. Subscription Plans and Payments

5.1 Plans

Spellweave offers different subscription tiers with varying features and limits. Plan details, pricing, and entitlements are displayed on our pricing page and may change over time.

5.2 Billing and Auto-Renewal

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). By subscribing, you authorize us to charge your payment method for the subscription fees plus any applicable taxes. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. It is your responsibility to manage your subscription and cancel if you no longer wish to be charged. You can cancel at any time through your account's billing settings.

5.3 Mana

Certain features (such as AI deck analysis and video generation) may require mana. Mana is non-refundable and has no cash value. Unused mana does not expire unless your account is terminated.

5.4 Cancellation

You may cancel your subscription at any time through your account's billing settings or the subscription management portal. Upon cancellation, you will retain access to paid features until the end of your current billing period. After that period ends, your account will revert to the free tier.

5.5 Refund Policy

All subscription payments and mana purchases are non-refundable. We do not provide refunds or credits for partial billing periods, unused subscription time, or unused mana balances. Because subscriptions renew automatically, you are responsible for canceling before your next renewal date to avoid being charged for the following period. Forgetting to cancel does not entitle you to a refund for any billing period during which you had access to the Service, regardless of whether you actively used it. By subscribing, you acknowledge and agree to this policy.

6. User Content

6.1 Your Content

You retain ownership of any content you create or upload to Spellweave, including collections, decks, and deck names ("User Content"). By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving our Service.

Content Responsibility: You represent and warrant that you own or have the necessary rights, licenses, and permissions to submit any User Content to the Service. You are solely responsible for ensuring your User Content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party.

6.2 AI-Generated Content

Content generated by our AI features (deck explanations, strategy visualizations) is created based on your inputs and deck data. You may use AI-generated content for personal, non-commercial purposes. Commercial use of AI-generated content may be subject to additional terms.

AI Output Disclaimer: AI-generated content is provided "as is" without any guarantee of accuracy, completeness, or suitability for any particular purpose. We do not warrant that AI-generated content is free from errors, factually correct, or legally compliant for your intended use. Strategy visualizations are fictional fantasy depictions and do not represent or depict any trademarked characters, artwork, or intellectual property. You are solely responsible for reviewing and verifying AI-generated content before use or distribution.

No Exclusivity: AI-generated outputs are provided to you for personal use. Spellweave does not guarantee exclusivity or uniqueness of generated content. Similar or identical outputs may be generated for other users. Spellweave retains the right to use anonymized and aggregated outputs to improve the Service.

6.3 Shared Content

When you share a deck or visualization via public link, you grant us permission to make that content accessible to anyone with the link. You can revoke this access by deleting the associated deck, which will also remove any linked visualizations.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers, etc.) to access the Service without permission
• Reverse engineer, decompile, or attempt to extract source code from the Service
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Circumvent any usage limits, access controls, or payment requirements
• Use AI features to intentionally generate content that infringes upon the intellectual property rights of any third party, including but not limited to trademarks, copyrights, or trade dress
• Attempt to manipulate or circumvent AI content safety measures or filters

8. Intellectual Property

8.1 Spellweave IP

The Service, including its original content, features, and functionality (excluding User Content and third-party content), is owned by Spellweave and is protected by copyright, trademark, and other intellectual property laws.

8.2 Magic: The Gathering

You acknowledge that Magic: The Gathering, card names, card images, mana symbols, and related content are property of Wizards of the Coast LLC. Spellweave is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Spellweave is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC.

8.3 Card Data

Card data and images are sourced from Scryfall under their API terms. Scryfall is not affiliated with Spellweave.

9. Third-Party Services

Our Service integrates with third-party services (including authentication providers, AI services, and cloud infrastructure). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• AI-generated content will be accurate, appropriate, or suitable for any purpose
• AI-generated content is free from intellectual property concerns or legally compliant for commercial use
• Strategy visualizations or other AI outputs will meet your expectations or requirements

AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results. You assume full responsibility for reviewing, verifying, and appropriately using any AI-generated content from the Service.

No Performance Guarantees: Spellweave does not guarantee competitive performance, win rates, or tournament outcomes. Deck recommendations, deck scores, and optimization suggestions are generated algorithmically and are provided for informational and entertainment purposes only.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPELLWEAVE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims under these Terms shall not exceed the amount you paid us, if any, in the twelve (12) months prior to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Spellweave and its licensors, service providers, employees, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us or using account deletion features within the Service.

Sections that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Spellweave operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spellweave regarding your use of the Service and supersede any prior agreements.
